Lindsay Lohan is no milkaholic.

And that’s likely why Lindsay is suing financial company
E-Trade for $100 million for using her name in its latest
commercial about a boyfriend-stealing “milkaholic” baby.

In the ad, which debuted during this year’s Super Bowl in
February, a baby boy apologizes to his girlfriend for not
calling her the night before.

“And that milkaholic Lindsay wasn’t over?” the baby girl
asks before another baby girl pops into the screen saying,
“Milk-a-whaaat?”

Lindsay filed the lawsuit Monday, which claims the ad
violated the star’s rights under New York state civil-
rights law.

Lil’ Wayne begins year-long prison term…

Rapper Lil’ Wayne has begun a year-long prison term after a
string of delays postponed his sentencing for weapons
possession, stemming from a 2007 arrest.

The “Lollipop” hitmaker, real name Dwayne Carter, pleaded
guilty last year to attempted criminal possession of a weapon,
and admitted to having a loaded .40-caliber semiautomatic gun
on his tour bus.

He was initially expected to be sentenced to a year behind
bars last month, but he was granted a postponement to undergo
dental surgery. The hearing was delayed again on March 2,
after a blaze in the basement of the courthouse forced
officials to evacuate the building and close it down for the
rest of the day.

Lil’ Wayne was finally sentenced at Manhattan Criminal Court
on Monday, March 8, and taken away in handcuffs to begin his
term at an undisclosed city jail immediately. According to
reports, Lil’ Wayne’s lawyer plans to ask for protective
custody out of concern for Wayne’s safety and health following
his dental surgeries.

He could be released in about eight months for good behavior.

Tom Cruise in motorcycle accident…

Tom Cruise narrowly avoided serious injury after crashing his
motorcycle in Los Angeles on Sunday, according to reports.

The “Mission: Impossible” star was riding through the city on
his motorbike when another car drove through a stop sign in
front of him, forcing him to swerve and hit a vehicle.

Tom was reportedly caught limping after the crash but he
refused to go to the hospital.

Tom’s red Ducati motorcycle was mangled in the crash and the
website reports the bike’s gears were “completely torn to
shreds on the left side.”

No other information was made available at the time.

Thank goodness he was not seriously injured.

Baby No. 2 on the Way for Rascal Flatts’s Rooney…

Make way for another little rascal: Joe Don Rooney and wife
Tiffany Fallon are expecting their second child.

“We’re a little more prepared but the same excitement is
there,” the Rascal Flatts guitarist says of baby No. 2.
The couple are already parents to 21-month-old son Jagger
Donovan. “There’s such fulfillment in being a father and
it’s going to be two-fold now, which is so cool.”

Tiffany, who is due in September, told Joe that she was
pregnant when they were staying in the same Los Angeles
hotel where he learned they were expecting Jagger.

“It was late January and we were out by the pool chilling
and she said, ‘I have something to show you,’ and she
opened her purse and pulled out the stick with the positive
sign,” he says. “I was like ‘Wow! We’re going to have to
stop coming to this hotel. We’ll have 16 of these things
before long!’ But life just couldn’t get better.”

Barbara Walters regrets quizzing Martin about sexuality…

Veteran broadcaster Barbara Walters regrets trying to force
Ricky Martin to open up about his sexuality in a 2000 interview,
because the question may have ended his career.

Barbara sat down with the “Livin’ La Vida Loca” hitmaker at the
height of his career and demanded to know if he is gay, and now
admits it is the one interview she regrets in her lengthy career.

And she fears the “inappropriate” questioning may have had an
affect on Ricky’s pop career.

Barbara comments, “In 2000, I pushed Ricky Martin very hard to
admit if he was gay or not, and the way he refused to do it
made everyone decide that he was. A lot of people say that
destroyed his career, and when I think back on it now I feel it
was an inappropriate question.”

Ricky, who is a single dad to twin sons, does not comment publicly
on his sexuality.

Winfrey Sees Herself in Gabourey Sidibe…

Oprah Winfrey asked to introduce Gabourey Sidibe at the Oscars
because she sees the young actress as a kindred spirit.

“I saw myself in her,” Winfrey said at the Governors Ball after
Sunday’s Academy Awards. “This whole roller coaster that happens
to you when you’re passionate about something, she wasn’t even
thinking of being an actress; she just auditioned. And now here
she is, being nominated alongside Meryl Streep, who is the
greatest actress in the world, with Sean Penn reading her name.
Only in America.”

Gabourey, who was nominated for Best Actress for her first
film, Precious, said she had no idea Oprah would be introducing
her. What did it mean to her? “It means that I just might be a
movie star,” Gabourey said.

In her tribute, Oprah compared the actress to “a true American
Cinderella on the threshold of a brilliant new career.” She
continued: “And ‘precious’ is but the first of many adjectives
coming your way, and they are all great.”

Gabourey was accompanied to the Oscars by her mother, Alice Tan
Ridley, who beamed at her daughter’s accomplishments. “I’m so
proud of her,” she commented. “This will be a lifetime memory
for her. Oprah brought me to tears talking about my daughter
tonight.”

Alec, who appeared alongside Leonardo in Martin Scorsese films
“The Aviator” and “The Departed,” is adamant his career is
a failure.

And he was left in awe of Leonardo on the “Aviator” set, because
the younger actor had “everything.”

He says, “I just feel like the kind of work I would love to have
done would have been more like when Leo did ‘The Aviator.’ I love
Leo. I adore him and envy him.

“I remember being there with him and thinking that he has youth,
he has talent, he has opportunity, he has everything in the
business. I thought, ‘What a great gift, to have that convergence
of all your abilities and the opportunity to work with Marty
Scorsese, and the scripts and the budgets and everything.’”

Here’s the Scoop….

24 is making it’s way to the movies!

With Kiefer Sutherland completely on-board as star, exec producer,
and contributor to the script, the flick is ready to head into
some key preliminary stages. The movie will find the nation’s
favorite counter terrorist unit officer heading to Europe to deal
with the bad guys.

The only thing that could be standing in the way of the show making
the move to a feature franchise is the TV show itself. If a ninth
season of the show comes through, than the movie will have to take
a back seat.

The buzz around the movie has begun. Start your clocks, 24 fans!

Howard Stern Confirms He’s in Talks to Judge Idol…

Howard Stern admitted Monday that he’s in talks to replace Simon
Cowell as a judge on American Idol.

“There’s not a better job on the planet than judging that f—ing
karaoke contest,” Howard, announced on his Sirius radio show.

“It would be the best thing that happened to me,” he continued.
“What a cush job… $100 million for four months. Who wouldn’t
take that?”

The catch?

“They’d have to pay me a ton of dough because I already make a ton
of dough,” says Howard. “$100 million to judge a karaoke contest?
Yeah, I would do that show for $100 million.”

Howard says he’d quit his radio show if he ended up on the Fox
reality show. His $500 million, five-year contract expires at the
end of 2010.

Naturally, he thinks he’d be perfect at the gig.

“If I do say so myself, I can’t imagine anyone else but me
replacing [Simon],” Howard said. “I mean, I don’t know. How else
are they going to make that show work? Who knows how to broadcast
and who knows how to be interesting? And who’s not afraid to speak
their mind?”

Marc Berman, the senior TV editor at Mediaweek, agrees.

“I probably can’t think of anybody better than him,” he tells says.
“He would create a lot of controversy. If they’re looking to keep
the show on the map, it’s not a bad idea.”

Angelina Jolie Heads to Haiti…

After her PDA-packed Super Bowl appearance with Brad Pitt,
Angelina Jolie jetted off to the Dominican Republic Monday
to visit hospitalized Haitian earthquake survivors and meet
with Dominican President Leonel Fernandez.

On Tuesday, the 34-year-old UN goodwill ambassador, who is
suing a British tabloid for claming that she plans to split
from Brad Pitt, is expected to travel to Haiti.

Last month, Angelina, who has visited everywhere from Iraq
to Thailand to Pakistan, announced that she and Brad
are donating $1 million to the emergency medical operation
in Haiti.

In a statement, she said: “It is incredibly horrible to see
a catastrophe of this size hit a people who have been
suffering from extreme poverty, violence and unrest for so
many decades.”

David Arquette, Courteney Cox Considering Adoption…

David Arquette says he and wife Courteney Cox are considering
expanding their family.

“I don’t know. I mean, it takes a lot for us to do it, so
maybe adoption,” David said on The Bonnie Hunt Show. Courteney,
underwent in-vitro fertilization to have Coco at age 39.

David added, “Listen, I like practicing as much as possible!
But it’s hard… I’m exhausted!”

Late last year, the National Enquirer reported the couple were
in the process of adopting, which her rep called “a complete
fabrication” at the time.

Meanwhile, daughter Coco is growing up to be just like her mom!

“She’s a little messy so that’s sort of on my side, but she’s
very strong-willed which is very Courteney-like,” he says.

“We got her a flute recently and she is just walking around
[pretending to play],” David adds. “We’re jammin’ a lot, a
little Jethro Tull.”

Charlie Sheen Charged With Assault, Hugs Wife in Court…

Actor Charlie Sheen was formally charged in an Aspen court Monday
for the Dec. 25 incident in which he allegedly attacked his wife
Brooke Mueller.

Chief Deputy District Attorney Arnold Mordkin filed three counts
against the actor: felony menacing, third-degree assault and
criminal mischief. Charlie could face one to three years in
prison if convicted for the menacing charge. (Third-degree assault
and criminal mischief are both misdemeanors.) Charlie has not
entered a plea for the charges.

In the same hearing, Judge James Boyd lifted a protective order
preventing Charlie and Brooke from communicating. The modification
comes after the couple had mutually requested they be allowed
contact in order to mend their marriage.

“They’re very much in love, and they want to try to work it out,”
Brooke’s attorney Yale Galenter explained.

Charlie’s attorney Richie Cummins assured Judge Boyd that his
client “has taken a number of steps” to work on his problems
with anger management and alcohol.

At the end of the hearing, Charlie and Brooke got up and hugged
each other warmly but left the courthouse separately.

It’s Leonardo DiCaprio…

Leo plays a detective trying to solve a missing persons mystery
in an asylum in the new Martin Scorsese movie, and decided to
study the mentally ill to perfect his role.

But admits he maybe took his homework a little too far: “There
was a tremendous amount of research done involving the
entrapments of mental illness and the suffering that people go
through, so it led me to watch a lot of different documentaries
on mental illness.

“For a few weeks there, it was some of the most hardcore film
experiences I’ve ever had. It was like reliving trauma in a
way. It was pretty intense.”

And the intensity didn’t stop when filming began.

Leo says, “We were surrounded by it (mental illness) every day.
We were surrounded by dilapidated walls of an old mental
institution. We had somebody there who was guiding us through
the history of mental illness, the pathways of treating it and
the different forms of treatment.”
